Sir,

1. I am directed to say that in pursuance of the decisions taken by the Govt on the recommendations of the Seven Central Pay Commission relating to Travelling Allowance entitlements, the Ministry of Finance have issued orders vide OM No.19030/1/2017-E.IV dated 13 July 2017 for modifying Travelling allowance entitlements of Civilian Central Govt employees. In pursuance thereto, sanction of the President is conveyed to the modifications in the Travel Regulations, 2014 (Edn) for Armed Forces Personnel as set out in Annexure to this letter.

2. The 'Pay Level' for determining the TA/DA entitlement is as indicated in relevant Special Army/Navy/Air Force Instructions.

3. The term 'Pay in the Level' for the purpose of these orders refers to Basic Pay drawn in appropriate Pay Level in the Pay Matrix as defined in relevant Special Army/Navy/Air Force instructions issued in pursuance to Govt decision on 7th CPC recommendations and does not include Non-Practising Allowance (NPA), Military Service Pay (MSP) or any other type of pay like special pay, etc.

4. However, if the Travelling Allowance entitlements in terms of the revised entitlements now prescribed result in a lowering of the existing entitlements in the case of any individual, groups, ranks or classes of service pers, the entitlements particularly in respect of mode of travel, class of accommodation, etc, shall not be lowered. They will instead continue to be governed by the earlier orders on the subject till such time as they become eligible, in the normal course, for the higher entitlements.

5. The claims submitted in respect of journey made on or after 1st July, 2017 may be regulated in accordance with these orders. In respect of journeys performed prior to 1st July, 2017, the claims may be regulated in accordance with the previous orders dated 29 Dec 2008.

6. It may be noted that no additional funds will be provided on account of revision in TAIDA entitlements. It may therefore be ensured that permission to official travel is given judiciously and restricted only to absolutely essential official requirements.

7. The relevant Rules of Travel Regulations will be amended in due course. As these orders are based on MoF OM No.F-19030/1/2017-E.IV dated 13 July, 2017 as well as further OM. No.19030/1/2017-E.IV dated 18 August, 2017, these OM would be referred to for settling any doubts/discrepancies.

8. These orders shall take effect from 01st July, 2017.

9. This issues with the concurrence of Ministry of Defence (Fin/QA) vide their UO No.505 dated15-9-2017.

Annexure to Govt of India, MoD letter No.12630/Mov C/242/D(Mov)/17 dated 15 Sept 2017. 

1. In partial modification of Govt of India, Ministry of Defence letter No.12630/Mov C/3737/D(Mov)/08 dated 29 Dec 2008 as amended from time to time, the following provisions will be applicable with effect from 01st Jul 2017.

2 Entitlements for Journeys on Tour or Training (Rule 57,58,62, 92, 95,107 and 108 of Travel Regulations, 2014 Edn).

(A) (i) Travel Entitlements within the Country (Rule 92, 95 and 108 of  Travel Regulations, 2014 Edn).

(ii) It has also been decided to allow the Government officials to travel by Premium Trains/Premium Tatkal Trains/Suvidha Trains, the reimbursement to Premium Tatkal Charges for booking of tickets and the reimbursement of Dynamic/Flexi-fare in Shatabdi/Rajdhani/Duronto Trains while on official tour/training. Reimbursement of Tatkai Seva Charges which has fixed fare, will remain continue to be allowed. Travel entitlement for the journey in Premium/Premium Tatkal/Suvidha/Shatabdi/Rajdhani/ Duronto Trains will be as under:-

(iii) The revised travel entitlements are subject to following:-
(a) In case of places not connected by rail, travel by AC bus for all those entitled to travel by AC II Tier and above by train and by Deluxe/Ordinary bus for others is allowed.

(b) In case of road travel between places connected by rail, travel by any means of public transport is allowed provided the total fare does not exceed the train fare by the entitled class.

(c) All mileage points earned by service personnel on tickets purchased for official travel shall be utilized by the concerned department for other official travel by their officers. Any usage of these mileage points for purposes of private travel by an officer will attract departmental action. This is to ensure that the benefits out of official travel, which is funded by the Government, should accrue to the Government.

(d) In case of non-availability of seats in entitled class, service pers may travel in the class below their entitled class.

(B)  International Travel Entitlement by Air - (Rule 245 of Travel Regulations, 2014 Edn).

OR
At prescribed rates for auto rickshaw for journeys by auto rickshaw, own scooter, motor cycle, moped, etc.

(ii) At places where no specific rates have been prescribed either by the Directorate of Transport of the concerned State or of the neighboring States:

For journeys performed in own car/taxi Rs. 24/- per Km
For journeys performed by auto rickshaw, own scooter, etc Rs.12/- per Km
Note : At places where no specific rates have been prescribed, the rate per km will further rise by 25 percent whenever DA increases by 50 percent.

E. (i) Daily Allowance on Tour - Rule 114 of Travel Regulations,(2014 Edn),
The rates of Daily Allowance are revised as follows:-

Reimbursement of AC taxi charges of up to 50 km per day for travel within the city.
Reimbursement of food bills not exceeding Rs1000/- per day.
9 to 11 Reimbursement for hotel accommodation/guest house of up to Rs .2,250/ per day.
Reimbursement  of non-AC  taxi  charges  of up to ' 338/per day for travel within the city.
Reimbursement of food bills not exceeding '900/- per day.
5A to 8 Reimbursement for hotel accommodation/guest house of up to Rs .750/- per day.
Reimbursement  of  Non-AC  taxi  charges  of  up  to Rs.225/- per day for travel within the city.
Reimbursement of food bills not exceeding Rs 800/- per day.
5 and below Reimbursement for hotel accommodation/guest house of up to Rs 450/- per day.
Reimbursement of non-AC taxi chares of up to Rs 113/- per day for travel within the city.
Reimbursement of food bills not exceeding Rs 500/- per day.

(ii) Reimbursement of Hotel Charges: - For levels 8 and below, the amount of claim (up to the ceiling) may be paid without production of vouchers against self-certified claim only. The self-certified claim should clearly indicate the period of stay, name of dwelling, etc. Additionally, for stay in Class 'X' cities, the ceiling for all employees up to level 8 would be ' 1,000 per day, but it will only be in the form of reimbursement upon production of relevant vouchers. The ceiling for reimbursement of hotel charges will further rise by 25 percent whenever DA increases by 50 percent.

(iii) Reimbursement of Travelling Charges:- Similar to Reimbursement of staying accommodation charges, for levels 8 and below, the claim (up to the ceiling) may be paid without production of vouchers against self-certified claim only. The self-certified claim should clearly indicate the period of travel, vehicle number, etc. The ceiling for levels 11 and below will further rise by 25 percent whenever DA increases by 50 percent. For journeys on foot, an allowance of Rs.12/- per kilometer travelled on foot shall be payable additionally. This rate will further increase by 25% whenever DA increases by 50%.

(iv) Reimbursement of Food Charges:- There will be no separate reimbursement of food bills. Instead, the lump sum amount payable will be as per Table E(i) above and, depending on the length of absence from headquarters, would be regulated as per Table (v) below. Since the concept of reimbursement has been done away with, no vouchers will be required. This methodology is in line with that followed by Indian Railways at present (with suitable enhancement or rates). i.e. Lump sum amount payable. The lump sum amount will increase by 25 percent whenever DA increases by 50 percent.

(v) Timing Restrictions

If absence from headquarters is > 12 hours 100% of Lump sum amount
Absence from Headquarter will be reckoned from midnight to midnight and will be calculated on a per day basis.


(vi) In case of stay/journey on Govt ships, boats etc. or journey to remote places on foot/mules etc for scientific/data collection purposes in organization like FSI, Survey of India, GSI etc., daily allowance will be paid at rate equivalent to that provided for reimbursement of food bill. However, in this case, the amount will be sanctioned irrespective of the actual expenditure incurred on this account with the approval of the Head of Department/Controlling Officer.
Note: DA rates for foreign travel will be regulated as prescribed by Ministry of External Affairs.

3  T.A. on Transfer - (Rule 57, 58, 60, 61, 62,67,69 and 70 of Travel Regulations , 2014 Edn).
TA on Transfer includes 4 components:-
(i) Travel entitlement for self and family.
(ii) Composite Transfer and packing grant (CTG).
(i) Reimbursement of charges on transportation of personal effects.
(ii) Reimbursement of charges on transportation of conveyance.

(i) Travel Entitlements:
(a) Travel entitlements as prescribed for tour in Para 2 above, except for International Travel, will be applicable in case of journeys on transfer. The general conditions of admissibility as laid down in Travel Regulations, 2014 Edn) will, however, continue to be applicable.
(b) The provisions relating to small family norms as contained in Para 2 (A) of Annexure to Ministry of Defence letter No.12630/Q Mov C/3198/D Mov/98 dated 28 Oct 1998 shall continue to be applicable. 

(ii) Composite Transfer and Packing Grant (CTG):
(a) The Composite Transfer Grant shall be paid at the rate 80% of the last month's basic pay in case of transfer involving a change of station located at a distance of or more than 20 kms from each other. However, for transfer to and from the Island territories of Andaman, Nicobar & Lakshadweep, CTG shall be paid at the rate of 100% of last month's basic pay. Further, NPA and MSP shall not be included as part of basic pay while determining entitlement for CTG.

(b) In cases of transfer to stations which are at a distance of less than 20 kms from the old station and of transfer within the same city, one third of the Composite Transfer Grant will be admissible, provided a change of residence is actually involved.

(c) In cases, where the transfer of husband and wife takes place within six months, but after 60 days of the transfer of the spouse, fifty percent of the Transfer Grant on transfer shall be allowed to the spouse transferred later. No Transfer Grant shall be admissible to the spouse transferred later, in case both the transfers are ordered within 60 days. The existing provisions shall continue to be applicable in case of transfers after a period of six months or more. Other rules precluding Transfer Grant in case of transfer at own request or transfer other than in public interest, shall continue to apply unchanged in their case.

(iii) Transportation of Personal Effects

(a) The rates will further rise by 25 percent whenever DA increases by 50 percent. The rates for transporting the entitled weight by Steamer will be equal to the prevailing rates prescribed by such transport in ships operated by Shipping Corporation of India. The claim for reimbursement shall be admissible subject to the production of actual receipts/vouchers by the service pers. Production of receipts/vouchers is mandatory in respect of transfer cases of North Eastern Region, Andaman & Nicobar Islands and Lakshadweep also.

(b) Transportation of personal effects by road is as per kilometre basis only. The classification of cities / towns for the purpose of transportation of personal effects is done away with.

(iv) Transportation of Conveyance �(Rule 67 & 70 of Travel Regulations, 2014 Edn).

The general conditions of admissibility of TA on transfer as laid down in Travel Regulations (2014 Edn) will, however, continue to be applicable.

4 T.A. Entitlement of Retiring Service Pers- (Rule 200-A & B of Travel Regulations, 2014 Edn).
TA on Retirement includes 4 components:-
(i) Travel entitlement for self and family.
(ii) Composite Transfer and packing grant (CTG).
(iii) Reimbursement of charges on transportation of personal effects.
(iv) Reimbursement of charges on transportation of conveyance.

(i)  Travel Entitlements.
Travel entitlements as prescribed for tour/transfer in Para 2 above, except for International Travel, will be applicable in case of journeys on retirement. The general conditions of admissibility as laid down in Travel Regulations (2014 Edn)  will, however, continue to be applicable.

(ii) Composite Transfer Grant (CTG) :
(a) The Composite Transfer Grant shall be paid at the rate of 80% of the last month's basic pay in case of those service pers, who on retirement, settled down at places other than last station(s) of their duty located at a distance of or more than 20 km. However, in case of settlement to and from the Island territories of Andatn2n, Nicobar & Lakshadweep, CTG shall be paid at the rate of 100% of last month's basic pay. Further, NPA and MSP shall not be included as part of basic pay while determining entitlement for CTG. The transfer incidentals and road mileage for journeys between the residence and the railway station/bus stand etc. at the old and new station are already subsumed in the composite transfer grant and will not be separately admissible.
(b) As in the case of serving employees, service pers who, on retirement, settle at the last station of duty itself or within a distance of less than 20 kms may be paid one third of the CTG subject to the condition that a change of residence is actually involved.

(iii) Transportation of Personal Effects: - Same as Para 3(iii) above.

(iv) Transportation of Conveyance: - Same as Para 3(iv) above.
The general condition of admissibility of TA on Retirement as laid down in Travel Regulations (2014 Edn) will, however, continue to be applicable.

In partial modification of Board's letter of even number dated 24. 08. 2017 on the subject, it has been decided by Board that para 2. A (i) & (ii) may be modified to read as under:

(i) Officers in level 14 and above, while on tour may be entitled for Air Travel in �J�/ Business Class.

(ii) All other Officers, otherwise authorized to travel by Air may be entitled to Travel by economy class. 

Further, it has also been decided by Board that in partial modification of item I (vii) of Board�s letter No. 2015-B-235 dated 21.07.2017, Officers in JAG/SG would be entitled for one way travel by economy class, if required on justification that Air travel is unavoidable. For JAG/SG cases of Air Travel, conditions mentioned in Note under para-22 of Delegation of powers to GM circulated vide Board�s letter No. F(X)II- 2015/PW/7 dated 12.06.2017 will need to be complied with.

The Department of Expenditure (DoE), Ministry of Finance vide their O.M�s No. F.No. 1-9024/22/2017-E.IV dated 19th July, 2017 have circulated certain guidelines regarding procedure for purchase of air tickets from authorized travel agents only for air travel on official tours.

OFFICE MEMORANDUM

Subject: Travel entitlements of Government employees for the purpose of LTC post Seventh Central Pay Commission-clarification reg.

The undersigned is directed to refer to this Department�s O.M. No. 31011/4/2008-Estt.A-IV dated 23.09.2008, which inter-alia provides that travel entitlements for the purpose of official tour/transfer or LTC, will be the same but no daily allowance shall be admissible for travel on LTC. Further, the facility shall be admissible only in respect of journeys performed in vehicles operated by the Government or any Corporation in the public sector run by the Central or State Government or a local body.

2. Consequent upon the decisions taken by Government on the recommendations of Seventh CPC relating to Travelling Allowance entitlements of Central Government employees, TA Rules have undergone changes vide Ministry of Finance�s O.M. No. 19030/1/2017-E.IV dated 13.07.2017.

3. In this regard, it is clarified that the travel entitlements of Government servants for the purpose of LTC shall be the same as TA entitlements as notified vide Ministry of Finance�s O.M. dated 13.07.2017, except the air travel entitlement for Level 6 to Level 8 of the Pay Matrix, which is allowed in respect of TA only and not for LTC.

4. Further, the following conditions may also be noted:

i. No daily allowance shall be admissible for travel on LTC.

ii. Any incidental expenses and the expenditure incurred on local journeys shall not be admissible.

iii. Reimbursement for the purpose of LTC shall be admissible in respect of journeys performed in vehicles operated by the Government or any Corporation in the public sector run by the Central or State Government or a local body.

iv. In case of journey between the places not connected by any public/Government means of transport, the Government servant shall be allowed reimbursement as per his entitlement for journey on transfer for a maximum limit of 100 Kms covered by the private/personal transport based on a self-certification from the
Government servant. Beyond this, the expenditure shall be borne by the Government servant.

v. Travel by Premium trains/Premium Tatkal trains/Suvidha trains is now allowed on LTC. Further, reimbursement of tatkal charges or premium tatkal charges shall also be admissible for the purpose of LTC.

vi. Flexi fare (dynamic fare) applicable in Rajdhani/Shatabdi/Duronto trains shall be admissible for the journey(s) performed by these trains on LTC. This dynamic fare component shall not be admissible in cases where a non-entitled Government servant travels by air and claims reimbursement for the entitled class of Rajdhani/Shatabdi/Duronto trains.

5. This O.M. will take effect from July 1, 2017.

OFFICE MEMORANDUM

Subject:- Procedure for empanelment of retired officers as the Inquiry Officers for conducting Departmental Inquiries- reg.

The undersigned is directed to state that the issue of utilizing the services of retired officers for conducting departmental inquiries had been under consideration of the Department. It has now been decided that panels of retired officers from the Ministries/Departments under Government of India and PSUs would be created and maintained by the respective Cadre Controlling Authorities for conducting Departmental Inquiries against the delinquent officials.

2. Procedure for empanelment of retired officers as the Inquiry Officers � Panels of retired officers not below the rank of Deputy Secretary in Central Government and equivalent officer in the State Governments/PSUs to be appointed as the Inquiry Officer for the purpose of conducting departmental inquiries would be maintained level/rank wise and place-specific by each cadre controlling authority where its offices are located.

3. Validity of the panel � The panel of the retired officers created for the purpose of appointing Inquiry Officers for conducting departmental inquiry will be valid for a period of three years. The respective Cadre Controlling Authority will ensure that a panel of retired Inquiry Officers is available with them.

4. Following are the eligibility conditions for appointment of willing retired officers as the Inquiry Officers to conduct departmental inquiries:-

(i) Retired officers who are willing to serve as Inquiry Officer.

(ii) He/she should not have been penalized in a Disciplinary Proceeding case (no penalty in DP or prosecution in criminal case)

5. The respective Cadre Controlling Authority will immediately take necessary action for inviting applications from willing and eligible retired officers to serve as the Inquiry Officer for conducting departmental inquiry. In this regard, a format for inviting applications is annexed.

6. A three-member committee consisting of Joint Secretary level officers including CVO of the concerned Ministry/Departments/PSUs would be constituted by the respective cadre controlling authority. The other two members can be from the same Ministry/Department or from the attached or subordinate office. After receipt of willingness of the retired officers, names of the officers will be screened by the committee so constituted. The formation of panel will be a continuous and ongoing process. The DA will decide on the appointment of the IO based on willingness for a case, experience in the sector and status of residence. Committee constituted for making panels of retired officers as the Inquiry Officer has to keep in mind that applications of retired officers willing to serve as an Inquiry Officer should be scrutinized carefully to ensure that the applicant meets the eligibility criteria.

7. The number of disciplinary cases assigned to an Inquiry Officer may be restricted to 8 cases in a year, with not more than 4 cases at a time.

8. Terms and conditions for appointment of retired officers as the Inquiry Officer. The designated Inquiry Officer shall require to give an undertaking as follows:-

(i) that he/she is not a witness or a complainant in the matter to be inquired into or a close relative or a known friend of the delinquent Government officer. A certificate to this effect will be obtained from the Inquiry Officer with respect to every inquiry and placed on record

(ii) shall maintain strict secrecy in relation to the documents he/she receives or information/data collected by him/her in connection with the inquiry and utilize the same only for the purpose of inquiry in the case entrusted to him/her.

9. No such documents/information or data shall be divulged to anyone during the Inquiry or after presentation of the Inquiry Report. All the records, reports etc. available with the Inquiry Officer shall be duly returned to the authority which appointed him/her as such, at the time of presentation of the Inquiry Report.

10. The Inquiry Officer shall conduct the inquiry proceedings at a location taking into account the availability of records, station/place where the misconduct occurred as well as the convenience of the witnesses/ PO etc. Video Conferencing should be utilized to the maximum extent possible to minimize travel undertaken by the IO/PO/CO. The cadre controlling authorities will facilitate necessary arrangements for the Video Conferencing.

11. The Inquiry Officer shall undertake travel for conducting inquiry (in unavoidable circumstances) with the approval of an authority as may be nominated by the concerned Ministry/Department.

12. The Inquiry Officer shall submit the inquiry report after completing the inquiry within 180 days from the date of his/her appointment as the Inquiry Officer. Extension of time beyond 180 days can be granted only by the Authority as may be prescribed.

13. The rates of honorarium and other allowances payable to the Inquiry Officer will be as under:-

Transport Allowance Rs. 40,000/- per case 
Subject to the condition that the for outstation journey, the actual expenses for Air/Railway AC 1 will be reimbursed in addition. (subject to the approval of the competent authority and for outstation journey by Air journey will be performed by Air India in the cheapest of the entitled class a per their status before retirement and tickets will have to be arranged through authorized /permissible sources as per MoF�s guidelines;. If journey is not performed by Air India, prior approval for travelling in airlines other than Air India would be required as per the prescribed procedure; Similarly travelling by train would also be permissible/restricted as per the far of class entitled to the officer before retirement.
Secretarial Assistance 'I' Where the number of witnesses cited in the charge sheet is more than 10 Rs.40,000/-
'II' Where the number of witnesses cited in the charge sheet are between 6-10 Rs.30,000/-
'III' Where the number of witnesses cited In the charge Rs.20,000/-

50% will be paid on submission of the Inquiry Report. Remaining amount will be paid within 45 days. In case it is not possible to proceed with the matter due to stay by courts etc., the Inquiry Officer may be discharged from his/her duties and payment of honorarium and other allowances will be made on pro rata basis.

14. Before the payment is received by the Inquiry Officer, it will be his/her responsibility to ensure that:-

(a) All case records and inquiry report (two ink signed copies) properly documented and arranged is handed over to the office of Disciplinary Authority.

(b) The report returns findings on each of the Articles of Charge which has been enquired into should specifically deal and address each of the procedural objections, if any, raised by the charged officers as per the extant rules and instructions.

(c) There should not be any ambiguity in the inquiry report and therefore every care should be taken to ensure that all procedures for conducting departmental inquiries have been followed in accordance with the relevant rules/instructions of disciplinary and appeal Rules to which the delinquent Government officials are governed.

15. Letter regarding engaging a retired officer as the Inquiry Officer will only be issued with the approval of the Disciplinary Authority of the Ministry/Department/ Office concerned.

16. A review of every empanelled Inquiry Officer will be done after receipt of 2 inquiry reports where adherence to time lines and the procedure and quality of work will be assessed by the concerned Ministry. Subsequent allocation of work may be done only after such evaluation. The services of Inquiry Officers whose performance is not upto the mark will be terminated with the approval of appointing authority.

17. Any issue arising out of this O.M. between the Inquiring Officer and the Disciplinary Authority will be decided by the Secretary , DoPT whose decision shall be final and binding on both parties.

18. These guidelines are issued for internal use of DoPT and other Cadre controlling authorities may adopt the same with suitable amendments.
