Subject: Implementation of Govemment�s decision on the recommendations of the Seventh Pay Commission - Revision of rate of Training Allowance.
Consequent upon the acceptance of the recommendations of the Seventh Central Pay Commission (CPC) by the Government conveyed vide Ministry of Finance, Department of Expenditure Resolution No. 11-1/2016-IC dated July 6, 2017, the President is pleased to decide that the Training Allowance in Training Academies and Institutes shall be regulated in the following manner:-

(i) Training Allowance

In the National/Central Training Academies and Institutes for Group �A� officers 24% of Basic Pay
In other Training Establishments 12% of Basic Pay

(ii) Training Allowance will be admissible only to the employees who join the training establishments for a specified period of time and are then likely to go back.

(iii) Training Allowance will not be admissible to those employees who are directly recruited by such training establishments for imparting training.

2. The revised rates of training allowance shall be admissible with effect from the lst July, 2017. 

3. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General.

Subject: Clarification regarding pay fixation under 7th CPC for the post of �Trainee� appointed on compassionate grounds.

Reference: This HQrs Circular of even no dated 01/02/2016.

With reference to the above cited circular, Ministry of Finance Dept. of Expenditure to whom the matter was referred has since clarified as under:

�Level -1 of the Pay Matrix introduced on implementation of the 7th CPC Report be the replacement for the pre-revised �1S scale. The pay of those governed by the IS scale may be revised by using the fitment factor of 2.57 for placement in Level -1 in conformity with the Rule 7 of the CCS(RP)Rules 2016. All pre-revised pay stages lower than pre-revised pay of Rs 7000 in the pre-revised �1S scale shall not be considered for determining the benefit of bunching, on the same lines as has been clarified by MoF(DoE)�s OM dated 3.08.2017 on application of the benefit on account of bunching�.

Subject: Establishing equivalence of posts in Central Public Sector Undertakings (PSUs), Banks, insurance institutions with Posts in Government for establishing Creamy Layer criteria - reg

The undersigned is directed to refer to DOPT OM No. 36012/22/93-Estt.(SOT) dated 8.9.1993 (copy as Annexure I) regarding reservation for Other Backward Classes in civil posts and services under the Government of india. In terms of para 3 of the said OM, similar instructions were to be issued in respect of Public Sector Undertakings and financial institutions including Public Sector Banks by Department of Public Enterprises and by the Ministry of Finance respectively.

2. Government had recently examined the proposal for establishing equivalence of posts in Central Public Sector Undertakings (PSUs), Banks, Insurance Institutions with Posts in Government for establishing Creamy Layer criteria amongst other Backard Classes. The Cabinet in its meeting held on 8.8.2017, inter-alia, approved para 5.2 of the Cabinet Note wherein the general principles for determination of organizations were proposed by the Ministry of Social Justice and Empowerment. Relevant extracts of para 5.2 and para 9 of the Cabinet Note are appended at Annexure II.

3. Department of Public Enterprises and Department of Financial Services are requested to advise all the public sector organizations under their respective administrative control to issue neessary orders immediately, in accordance with principles approved by the Cabinet as appended in Annexure II, so as to conclude the exercise before 31st March, 2018.

4. It is also rquested that orders issued in the matter may kindly be arranged to be endorsed by all concerned to this Department as well as M/o Social Justice & Empowerment for our record.

Subject: Extension of probation period on account of availing Leave during probation period. 

The undersigned is directed to refer to this Department's O.M No. 28020/1/2010-Estt(C) dated 21st July 2014 wherein consolidated instructions on Probation/ Confirmation in Central Services were issued for ready reference to all concerned. As per extant instructions � if during the period of probation, a probationer has not undergone the requisite training course..., the period of probation may be extended by such period or periods as may be necessary, subject to the condition that the total period of probation does not exceed double the prescribed period of probation.

2. This has been examined in the view that some employees are not able to complete the probation on account of availing leave for long duration during probation period. It has been decided that in such cases if an employee does not complete 75% of the total duration prescribed for probation on account of availing any kind of leave as permissible to a probationer under the Rules, his/ her probation period may be extended by the length of the Leave availed, but not exceeding double the prescribed period of probation.

3. So far as persons serving in the Indian Audit & Accounts Departments are concerned, these orders are being issued after consultation with the C&AG of India.

Sub: Fixation of the pay of the pre-revised pay scale of 1S scale granted to candidates appointed as trainees on compassionate grounds in the seventh central pay commission (7th CPC) -reg.

The undersigned is directed to invite attention to this Department�s O.M.No.14014/02/2012-Estt(D) dated 16.01.2013 containing consolidated instructions on the subject of compassionate appointments. with regard to appointment of candidates not immediately meeting the educational standards as trainees these instructions provide as under:-

� In exceptional circumstances Government may consider recruiting persons not immediately meeting the minimum educational standards. Government may engage them as trainees who will be given the regular pay bands and grade pay only on acquiring the minimum qualification prescribed under the recruitment rules. The emoluments of these trainees, during the period of their training and before they are absorbed in the Government as employees, will be governed by the minimum of the 1S pay band Rs.4440-7440 without any grade pay. In addition, they will be granted all applicable Allowance, like Dearness Allowance, House Rent Allowance and Transport Allowance at the admissible rates. The same shall be calculated on the minimum -1s pay band without any grade pay. the period spent in the -1S pay band by the future recruits will not be counted as service for any purpose as their regular service will start only after they are placed in the pay band PB-1 of Rs.5200-20200 along with grade pay of Rs.1800.�

2. The 7th CPC has not provided any replacement scale for 1S Pay band of Rs.4440-7440 without any grade pay which is granted to trainees appointed under the scheme for compassionate appointment. The matter was taken up with the Department of Expenditure and it has now been decided by the Government that Level-1 of the pay Matrix introduced on implementation of the 7th CPC Report be the replacement for the pre-revised-1S scale. The pay of those governed by the 1S scale may be revised by using the Fitment Factor of 2.57 for placement in Level-1 in conformity with the Rule 7 of the CCS (RP) Rules,2016. All pre-revised pay stages lower than pre-revised pay of Rs.7,000 in the pre-revised 1S scale shall not be considered for determining the benefit of bunching, on the same lines as has been clarified by this Department�s O.M dated 03.08.2017 on application of the benefit on account of bunching.

3. This will be effective from 01.01.2016.

Subject: Travel entitlements of Government employees for the purpose of LTC post Seventh Central Pay Commission-clarification reg.

The undersigned is directed to refer to this Department�s O.M. No. 31011/4/2008-Estt.A-IV dated 23.09.2008, which inter-alia provides that travel entitlements for the purpose of official tour/transfer or LTC, will be the same but no daily allowance shall be admissible for travel on LTC. Further, the facility shall be admissible only in respect of journeys performed in vehicles operated by the Government or any Corporation in the public sector run by the Central or State Government or a local body.

2. Consequent upon the decisions taken by Government on the recommendations of Seventh CPC relating to Travelling Allowance entitlements of Central Government employees, TA Rules have undergone changes vide Ministry of Finance�s O.M. No. 19030/1/2017-E.IV dated 13.07.2017.

3. In this regard, it is clarified that the travel entitlements of Government servants for the purpose of LTC shall be the same as TA entitlements as notified vide Ministry of Finance�s O.M. dated 13.07.2017, except the air travel entitlement for Level 6 to Level 8 of the Pay Matrix, which is allowed in respect of TA only and not for LTC.

4. Further, the following conditions may also be noted:

i. No daily allowance shall be admissible for travel on LTC.

ii. Any incidental expenses and the expenditure incurred on local journeys shall not be admissible.

iii. Reimbursement for the purpose of LTC shall be admissible in respect of journeys performed in vehicles operated by the Government or any Corporation in the public sector run by the Central or State Government or a local body.

iv. In case of journey between the places not connected by any public/Government means of transport, the Government servant shall be allowed reimbursement as per his entitlement for journey on transfer for a maximum limit of 100 Kms covered by the private/personal transport based on a self-certification from the
Government servant. Beyond this, the expenditure shall be borne by the Government servant.

v. Travel by Premium trains/Premium Tatkal trains/Suvidha trains is now allowed on LTC. Further, reimbursement of tatkal charges or premium tatkal charges shall also be admissible for the purpose of LTC.

vi. Flexi fare (dynamic fare) applicable in Rajdhani/Shatabdi/Duronto trains shall be admissible for the journey(s) performed by these trains on LTC. This dynamic fare component shall not be admissible in cases where a non-entitled Government servant travels by air and claims reimbursement for the entitled class of Rajdhani/Shatabdi/Duronto trains.

5. This O.M. will take effect from July 1, 2017.

Subject: � Dharna Notice for 19th September, 2017 and 17th October. 2017 � Instructions under CCS (Conduct Rules), 1964 � Regarding.

It has been brought to the notice of the Government that Confederation of Central Government Employees and Workers has decided to observe dharna at district headquarters across the country on 19th September. 2017 followed by similar protest at all State capitals on 17th October. 2017. The proposed protests are in support of pay and service related demands.

2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave. go slow, sit-down etc. or any action that abet any form of strike in violation of Rule 7 of the CCS (Conduct) Rules. 1964. Besides. in accordance with the proviso to Rule 17(I) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed. they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It Follows that the right to form an Association does not include any guaranteed right to strike. There is no statutory provision empowering _the employees to 20 on strike. The Supreme Court has also ruled in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with the law. Any employee going on strike in any form. including dharna, would thee the consequences which. besides deduction of wages. may also include appropriate disciplinary action. Attention of all employees of this Department is also drawn to this Department�s O.M. No.33012/1/(s)/2008- Estt.(B) dated 12.9.2008. on the subject for strict compliance.

3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or other kind of leave to the officers and employees if applied for. during the period of proposed dharna and ensure that the willing employees are allowed hindrance free entry into the office premises.

4. In case employees go on dharna all divisional heads are requested to forward a report indicating the number and details of employees who are absent from duty on the day of strike i.e. 19.09.2017 and 17.10.2017.

Subject:- Procedure for empanelment of retired officers as the Inquiry Officers for conducting Departmental Inquiries- reg.

The undersigned is directed to state that the issue of utilizing the services of retired officers for conducting departmental inquiries had been under consideration of the Department. It has now been decided that panels of retired officers from the Ministries/Departments under Government of India and PSUs would be created and maintained by the respective Cadre Controlling Authorities for conducting Departmental Inquiries against the delinquent officials.

2. Procedure for empanelment of retired officers as the Inquiry Officers � Panels of retired officers not below the rank of Deputy Secretary in Central Government and equivalent officer in the State Governments/PSUs to be appointed as the Inquiry Officer for the purpose of conducting departmental inquiries would be maintained level/rank wise and place-specific by each cadre controlling authority where its offices are located.

3. Validity of the panel � The panel of the retired officers created for the purpose of appointing Inquiry Officers for conducting departmental inquiry will be valid for a period of three years. The respective Cadre Controlling Authority will ensure that a panel of retired Inquiry Officers is available with them.

4. Following are the eligibility conditions for appointment of willing retired officers as the Inquiry Officers to conduct departmental inquiries:-

(i) Retired officers who are willing to serve as Inquiry Officer.

(ii) He/she should not have been penalized in a Disciplinary Proceeding case (no penalty in DP or prosecution in criminal case)

5. The respective Cadre Controlling Authority will immediately take necessary action for inviting applications from willing and eligible retired officers to serve as the Inquiry Officer for conducting departmental inquiry. In this regard, a format for inviting applications is annexed.

6. A three-member committee consisting of Joint Secretary level officers including CVO of the concerned Ministry/Departments/PSUs would be constituted by the respective cadre controlling authority. The other two members can be from the same Ministry/Department or from the attached or subordinate office. After receipt of willingness of the retired officers, names of the officers will be screened by the committee so constituted. The formation of panel will be a continuous and ongoing process. The DA will decide on the appointment of the IO based on willingness for a case, experience in the sector and status of residence. Committee constituted for making panels of retired officers as the Inquiry Officer has to keep in mind that applications of retired officers willing to serve as an Inquiry Officer should be scrutinized carefully to ensure that the applicant meets the eligibility criteria.

7. The number of disciplinary cases assigned to an Inquiry Officer may be restricted to 8 cases in a year, with not more than 4 cases at a time.

8. Terms and conditions for appointment of retired officers as the Inquiry Officer. The designated Inquiry Officer shall require to give an undertaking as follows:-

(i) that he/she is not a witness or a complainant in the matter to be inquired into or a close relative or a known friend of the delinquent Government officer. A certificate to this effect will be obtained from the Inquiry Officer with respect to every inquiry and placed on record

(ii) shall maintain strict secrecy in relation to the documents he/she receives or information/data collected by him/her in connection with the inquiry and utilize the same only for the purpose of inquiry in the case entrusted to him/her.

9. No such documents/information or data shall be divulged to anyone during the Inquiry or after presentation of the Inquiry Report. All the records, reports etc. available with the Inquiry Officer shall be duly returned to the authority which appointed him/her as such, at the time of presentation of the Inquiry Report.

10. The Inquiry Officer shall conduct the inquiry proceedings at a location taking into account the availability of records, station/place where the misconduct occurred as well as the convenience of the witnesses/ PO etc. Video Conferencing should be utilized to the maximum extent possible to minimize travel undertaken by the IO/PO/CO. The cadre controlling authorities will facilitate necessary arrangements for the Video Conferencing.

11. The Inquiry Officer shall undertake travel for conducting inquiry (in unavoidable circumstances) with the approval of an authority as may be nominated by the concerned Ministry/Department.

12. The Inquiry Officer shall submit the inquiry report after completing the inquiry within 180 days from the date of his/her appointment as the Inquiry Officer. Extension of time beyond 180 days can be granted only by the Authority as may be prescribed.

13. The rates of honorarium and other allowances payable to the Inquiry Officer will be as under:-

Transport Allowance Rs. 40,000/- per case 
Subject to the condition that the for outstation journey, the actual expenses for Air/Railway AC 1 will be reimbursed in addition. (subject to the approval of the competent authority and for outstation journey by Air journey will be performed by Air India in the cheapest of the entitled class a per their status before retirement and tickets will have to be arranged through authorized /permissible sources as per MoF�s guidelines;. If journey is not performed by Air India, prior approval for travelling in airlines other than Air India would be required as per the prescribed procedure; Similarly travelling by train would also be permissible/restricted as per the far of class entitled to the officer before retirement.
Secretarial Assistance 'I' Where the number of witnesses cited in the charge sheet is more than 10 Rs.40,000/-
'II' Where the number of witnesses cited in the charge sheet are between 6-10 Rs.30,000/-
'III' Where the number of witnesses cited In the charge Rs.20,000/-

50% will be paid on submission of the Inquiry Report. Remaining amount will be paid within 45 days. In case it is not possible to proceed with the matter due to stay by courts etc., the Inquiry Officer may be discharged from his/her duties and payment of honorarium and other allowances will be made on pro rata basis.

14. Before the payment is received by the Inquiry Officer, it will be his/her responsibility to ensure that:-

(a) All case records and inquiry report (two ink signed copies) properly documented and arranged is handed over to the office of Disciplinary Authority.

(b) The report returns findings on each of the Articles of Charge which has been enquired into should specifically deal and address each of the procedural objections, if any, raised by the charged officers as per the extant rules and instructions.

(c) There should not be any ambiguity in the inquiry report and therefore every care should be taken to ensure that all procedures for conducting departmental inquiries have been followed in accordance with the relevant rules/instructions of disciplinary and appeal Rules to which the delinquent Government officials are governed.

15. Letter regarding engaging a retired officer as the Inquiry Officer will only be issued with the approval of the Disciplinary Authority of the Ministry/Department/ Office concerned.

16. A review of every empanelled Inquiry Officer will be done after receipt of 2 inquiry reports where adherence to time lines and the procedure and quality of work will be assessed by the concerned Ministry. Subsequent allocation of work may be done only after such evaluation. The services of Inquiry Officers whose performance is not upto the mark will be terminated with the approval of appointing authority.

17. Any issue arising out of this O.M. between the Inquiring Officer and the Disciplinary Authority will be decided by the Secretary , DoPT whose decision shall be final and binding on both parties.

18. These guidelines are issued for internal use of DoPT and other Cadre controlling authorities may adopt the same with suitable amendments.
